What is a Guardian ad Litem?
The term "Guardian ad Litem" is from Latin origin, meaning "for the lawsuit," i.e., for purposes of the current legal action. A Guardian ad Litem (“GAL”) is an attorney that is appointed by the Court to help investigate and to file a report of findings and recommendations to the court. The investigation, report, and recommendations are based upon what the GAL believes to be in the best interests of the child, and acts as a neutral investigator. The GAL represents the best interests of the child involved in the litigation.
What does a Guardian ad Litem do?
The GAL acts as an investigator for the court, as to eliminate the bias and the "he said, she said" of the parties. The GAL investigates all aspects of the case, speaks with the child and their teachers, therapists, doctors, etc. Conversations with the child which would otherwise be inadmissible as hearsay can be voiced through the GAL. The investigation is very in-depth. The GAL talks to the parents, the child, family members, and people who have been in close contact with the child. The GAL also looks at various documents and information that helps them with their investigation and recommendations. The GAL can conduct home visits and visit the child's school. The GAL can also testify at any hearing or at trial. In short: the report and recommendation of the GAL carries a lot of weight with the Court when making its decisions on child custody and timesharing schedules.
What is the Guardian ad Litem's role?
The Guardian ad Litem will be present at all court hearings, mediations, and can file a response to motions and appeals which affect their recommendations. A GAL will be involved from the moment of appointment until when there is a resolution. The Guardian ad Litem is also involved in the mediation process and must approve of the agreement before it is ratified.
What is the purpose of a Guardian ad Litem?
The purpose of the Guardian ad Litem is to assist the Court in making factual findings as to what is in the best interests of the child.
